Terms & Conditions
Last updated: 10 May 2025 | Effective: 10 May 2025
These terms govern your use of the Kasturi website and the consulting services we provide. Please take a moment to read them carefully. If you have questions about anything here, we are happy to clarify before you engage with us.
1. About Kasturi
Kasturi is a business consulting firm operating in Malaysia. Our principal address is No. 12, Jalan Kia Peng, 50450 Kuala Lumpur. We provide structured business planning services to small business owners and individuals preparing to start a business. References to "we", "us", or "our" throughout these terms refer to Kasturi.
2. Scope of These Terms
These terms apply to:
- Your use of this website and any content published on it
- Enquiries submitted through our contact form or by phone or email
- Consulting engagements entered into with Kasturi
By accessing this website or engaging our services, you acknowledge that you have read and understood these terms. If you do not agree with any part of them, please do not use this website or proceed with an engagement.
3. Our Services
We offer three consulting engagements:
- Rough Sketch (RM 690): A single session to structure your thinking and produce a one-page plan outline.
- Detailed Plans (RM 2,050): A five-week engagement to develop a full written business plan with two sessions and a follow-up.
- Master Plan Partnership (RM 3,320): A six-month advisory relationship with monthly sessions, quarterly reviews, and ongoing planning support.
The specific scope of each engagement will be agreed in writing before work begins. We do not begin any paid engagement without a written confirmation from you.
4. Enquiries and Engagement Process
Submitting an enquiry through our website does not create a binding agreement. An engagement only begins when:
- We have confirmed availability and discussed scope with you
- You have received and accepted our engagement letter or written summary
- Payment or a payment arrangement has been confirmed as agreed
We will always be straightforward about what is included before any commitment is made on either side.
5. Fees and Payment
All fees are stated in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless stated otherwise. Payment terms will be specified in your engagement confirmation. Generally:
- Rough Sketch: full payment prior to the session
- Detailed Plans: a deposit prior to commencement, with the balance due on delivery of the written plan
- Master Plan Partnership: monthly payments as agreed in the engagement letter
If your circumstances change and you need to discuss payment timing, please contact us as early as possible. We will always try to find a workable arrangement.
6. Rescheduling and Cancellations
We understand that business circumstances can change. Our approach to rescheduling and cancellations is as follows:
- Rescheduling: Sessions may be rescheduled with at least 48 hours' notice at no additional charge. Last-minute rescheduling may result in the session being forfeited.
- Cancellation by you: If you cancel before any work has commenced, we will issue a refund less any administrative costs incurred. Cancellation after commencement will be handled according to the engagement letter.
- Cancellation by us: If we need to cancel a session or engagement for any reason, we will notify you promptly and arrange a full refund of any unused fees.
7. Confidentiality
We take the confidentiality of your business information seriously. Information you share with us during an engagement — including business plans, financial details, and strategic ideas — will not be disclosed to any third party without your consent, except where required by Malaysian law.
In return, we ask that materials and frameworks shared with you during an engagement are used for your own business purposes and are not resold or redistributed.
8. Nature of Our Advice
The guidance we provide is based on our experience and the information you share with us. Our work aims to help you think more clearly about your business direction. It is not a substitute for legal, financial, accounting, or tax advice. For matters requiring those disciplines, we encourage you to consult appropriately qualified professionals.
We do not make representations about the future performance of any business. Business outcomes depend on many factors beyond the scope of a consulting engagement.
9. Intellectual Property
All materials we produce specifically for your engagement — including plan documents, outlines, and written summaries — are provided for your use. General frameworks, templates, and methodologies we use in our work remain the intellectual property of Kasturi.
All content on this website, including text, layout, and design, is the property of Kasturi. It may not be reproduced or distributed without our written permission.
10. Limitation of Liability
To the extent permitted by Malaysian law, our liability in connection with any consulting engagement is limited to the fees paid by you for that specific engagement. We are not liable for any indirect, consequential, or speculative loss arising from the use of our advice or materials.
Nothing in these terms excludes or limits liability for fraud, gross negligence, or any other matter that cannot be excluded under applicable law.
11. Website Use
This website is provided for informational purposes. While we take care to keep information current and accurate, we do not warrant that all content is free from errors or omissions. We reserve the right to update or remove content at any time without notice.
You must not use this website in any way that is unlawful, harmful, or that could damage the reputation of Kasturi. Automated scraping or data extraction from this website without our permission is not permitted.
12. Links to External Websites
This website may include links to external websites for your convenience. We do not control those websites and are not responsible for their content, privacy practices, or availability. A link does not constitute an endorsement.
13. Privacy
Your personal data is handled in accordance with our Privacy Policy, which forms part of these terms. By using our website or engaging our services, you acknowledge that you have read our Privacy Policy.
14. Governing Law
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from a consulting engagement will first be addressed through good-faith discussion between the parties. If a resolution cannot be reached, the matter will be referred to the courts of Malaysia.
15. Changes to These Terms
We may update these terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For active clients, we will provide notice of any material changes. Continued use of our website or services after a change constitutes acceptance of the revised terms.
